The following Terms and Conditions below apply to the Koplo Pentas Borneo 2024 Concert Ticket Giveaway (“the Contest”) held by Sarawak Media Group (“SMG”) for Koplo Pentas
Borneo 2024 Concert.
Any person join and enter for the Contest shall be referred to as the “Participant”.
- Introduction
1.1 The Contest is free to enter (no purchase required, unless otherwise stated). - Eligibility and entry restrictions
2.1 To be eligible to enter the Contest, Participant must be a legal residents who are physically located in Malaysia;
2.2 Participant must be a real person.
2.3 Participant must not be SMG’s employee or any person involved in the running of the Contest, and Participant must not be a family relation of any such person. - Participation
3.1 Participant has to fulfil the following steps to be eligible for the Contest:
a) Participant has to follow TikTok TVS Entertainment account (@tvs_entertainment);
b) Participant need to set their TikTok account as publicly viewable;
c) TVS will announce the Contest during ‘Inspirasi Duniamu’ live program on 10 February 2024 and poster of the Contest will be uploaded to TVS’s social media account on the same day;
d) Participants are required to comment their favourite artist who will perform during Koplo Pentas Borneo 2024 on the poster posted on TikTok TVS Entertainment Account and tag three (3) friends;
e) There will be five (5) winners and the winners will be selected through TVS Lucky Draw system;
f) The Lucky Draw system and the winner will be aired and announced during the ‘Inspirasi Duniamu’ live program on 14 February 2024. Winners will also be contacted through their TikTok accounts via Direct Message.3.2 Participant must have a genuine TikTok account (“TikTok Account”) and publicly viewable;
3.3 By entering, Participant agree to be bound by the decisions of SMG, these Terms and Conditions and to comply with all federal, provincial, state, and local laws and regulations;
3.4 The entry and participation shall be deemed to have been submitted by the authorized holder of the TikTok Account visible to the SMG; and
3.5 The participation may not contain references which are obscene, crude or vulgar, gang identification, phone numbers, personal addresses (physical or email), Web site URLs, derogatory characterizations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behaviour or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by SMG, in its sole discretion. - Contest Period
4.1 The Contest shall commence on 10 February 2024 and shall close on 13 February
2024 at 11.59 pm (“Contest Period”).
4.2 Any entries received before or after the Contest Period will be invalid and will not be
entered as Participant.
4.3 SMG reserve the right to cancel or amend the Contest Period and these Terms and
Conditions without notice in the event of a catastrophe, war, civil or military
disturbance, act of God or any actual or anticipated breach of any applicable law or
regulation or any other event outside of our control. - Winners and prizes
5.1 SMG will record the TikTok username of the Participant with the correct answer and paste it into TVS Lucky Draw System.
5.2 The Lucky Draw System and results of the Contest will be aired and announced during ‘Inspirasi Duniamu’ live program on 14 February 2024. The announcement may include the name, username of TikTok Account and prize details of each prize winner.
5.3 The Contest’s prize result and winners will also be notified through TikTok Account of the Participant via Direct Message.
5.4 One Participant is only eligible for one (1) prize (a pair of Koplo Pentas Borneo 2024 Concert, Silver Zone ticket) regardless of the number of entries.
5.5 Participant must therefore ‘follow’ TVS Entertainment TikTok account in order to be contacted about prizes. Participant will receive their prizes not more than three (3) days following that closing date.
5.6 Reasonable efforts will be made to contact the prize winner but if the winner fails to respond to our notification attempts within this time or fails to meet any of the eligibility requirements or is otherwise unable to comply with this Terms and Conditions, SMG reserve the right to disqualify that entrant of the Participant and offer the prize to the next eligible entrant participants and thereafter until a winner is found.
5.7 The prizes shall be redeemed and collected by the Participant at SMG office. Parental/ legal guardian is required for the Participant below 18 years old during the collection of prize at SMG office.
5.8 No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and SMG reserve the right to substitute any prize with another of equivalent value without giving notice.
5.9 Utilization of the prizes shall be subject to this Terms and Conditions. SMG shall not be liable for any failure of the Participant who win the Contest to use the prize.
5.10 All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in the Contest and to redeem the prize is the sole responsibility of the Participant(s) and/or winner(s).
5.11 Participant is responsible for any and all taxes payable as a result of a prize being awarded or received. - Copyright and Publicity
6.1 Participant grant to SMG rights to store, edit, distribute, transmit and publish Participant’s information.
6.2 Participant represent and warrant that:
a) By participating in this Contest, you consent to SMG’s collection of your personal data in order to conduct the Contest and agree that SMG may, for this purpose, collect, use and/or disclose your personal data in accordance with these Terms and Conditions;
b) Participant own and/or control 100% of all right, title and interest in and to information provided which shall include personal data, as well as all elements contained therein;
c) the information provided which shall include personal data shall not violate any law or the copyright, trademark, publicity right, privacy right, or any other right of any third party;
d) Participant hereby hold SMG and TVS harmless from and against any third party claim arising from the participation in this Contest. Participant waive any right to privacy. Participant waive any right to inspect or approve uses of the personal data and answer or to be compensated for any such uses; and
e) By participating in this Contest, Participant grants to SMG and its affiliated companies, the right, except where prohibited by law, to use your name, picture, address (city and state), e-mail address, voice, biographical information, entry form information and written and oral statements, for advertising and promotional purposes in promoting or publicizing the Contest, SMG and its products and services, without compensation unless required by law. Participant shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e-mail address, biographical information, or entry. The rights granted under this paragraph shall extend to SMG and its affiliated companies with respect to all Participant in the Contest, including the Participant who is selected as the winners and those Participant who are not selected as the winners. - Release from Any and All Liability.
7.1 Participant agree that SMG and its officers, directors, employees, affiliates, and subsidiaries shall not be liable for losses or injuries of any kind resulting from:
a) acceptance/possession and/or use/misuse of prize(s);
b) participation of the Participant in the Contest;
c) individual, joint or collective technical malfunctions of the transmission line, computer on-line system, telephone network or lines, computer dating mechanism, computer equipment, hardware and/or software; or
d) any delay or distortion of an entry resulting from data transmissions that are garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Terms and Conditions. Participant also agree that SMG is not responsible or liable for any injury or damage to the Participant’s or third person related to or resulting from the Contest and/or its prizes. SMG is not liable for damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to Participant’s participation in the Contest or downloading of information in connection with the Contest. SMG reserves the right to modify or cancel the Contest in the event that any portion of any website used to administer any aspect of the Contest becomes technically corrupted. - Use of Data
8.1 By entering the Contest, each Participant consent to the collection, use and distribution of his/her personal information (information that identifies Participant as an individual, such as, but not limited to, home telephone number, age and home address) by SMG for the purposes of implementing, administering and fulfilling the Contest. SMG will not sell or transmit this information to third parties other than for the purpose of the Contest. - Issues of Law.
9.1 The Contest and these Terms and Conditions will be governed by Malaysian law applicable in Sarawak and any disputes will be subject to the exclusive jurisdiction of the courts of Malaysia. - Severability
10.1 If any of these Terms and Conditions is held to be invalid or unenforceable, such term shall be struck out and the remaining terms shall be enforced. - Amendment
11.1 SMG reserves the right to at any time, change, amend, delete or add to the terms and conditions herein and other rules and regulations including the mechanism of the Contest at its absolute discretion. - Contact
